What is Legal Funding?
Up until a week ago, I didn’t know what legal funding meant and what it was for. All I know was this, when there is a lawsuit, it involves two parties, two attorneys, a judge, courtroom and heaps amount of money. Legal funding wasn’t even in my vocabulary because I didn’t think, that a plaintiff can file a lawsuit, pursue to win it, and not spend any personal money.
There are many names associated to legal funding. A legal funding can also be called as Lawsuit funding, Lawsuit loan, pre settlement funding or legal financing. Now, with all the other names that it is called, what is legal funding? It’s a process that grants cash to plaintiffs who have been injured or damaged in any way and wants to file a lawsuit case. The cash is to assist the plaintiffs to any type of financial needs to keep the case active and bring it to a final settlement.
The next question is, who should be eligible to get legal funding grants? We mentioned the plaintiff earlier because it is the person who had been aggravated. Filing a lawsuit without sufficient amount of money can be very difficult but with legal funding, going through the entire process of a case can be possible. Any type of financial need that is related to the case that is being filed by the plaintiff is covered by legal funding. If hospitalization is needed, then the money can directly be taken from a legal funding.
For a legal funding request to be valid, a plaintiff must already have an attorney to represent the case. The purpose of this is to ensure that the case can be handled well and won by the plaintiff and the representing attorney. Legal funding initiates great aid for the plaintiff because even when they are away from work due to an injury, psychological or emotional distress, financial support can continuously be provided for the plaintiff’s benefit.
Oftentimes,a plaintiff who is in the right position to file a lawsuit, hesitates to do so. The main reason, if not the only, is that financial issues become such a great obstacle. Though there is already such a paramount damage to the plaintiff, filing a lawsuit can be troublesome if financial resource is limited. Legal cases, when processed, take a long time for settlement. It can wear people down. It also asks for huge amount of money overtime. These reasons may already initiate doubt and fear coming from the plaintiff’s side.
What is important now is that, there should be more transparency on legal funding. People must learn all that there is to learn about legal funding and how important it is for potential plaintiffs who want to win a case in their own individual ways.
